Terms and Conditions

Last Updated:

1. Introduction and Scope

These Terms and Conditions (“Terms”) govern the relationship between MYCOTRON (“we”, “us”, “our”) and the customer (“you”, “user”) regarding the purchase of the MYCOTRON automated mushroom cultivation device and related accessories via our website https://mycotron.eu (including its alias https://mycotron.com).

By registering an account, accessing our online store, or placing an order, you agree to be fully bound by these Terms. If you do not agree, you must refrain from using our e-commerce services.

2. Geographic Restrictions (EU Only)

  • Shipping Area: On the current stage of operations, we explicitly restrict commercial operations and shipping strictly to member states of the European Union (EU).
  • Order Cancellation: We do not ship to countries outside the EU customs zone (e.g., the United States, Canada, the United Kingdom, or Switzerland). Any orders placed with a shipping address outside the European Union will be automatically cancelled, and a full refund will be issued minus any transactional payment gateway fees.

3. Account Registration and Use

  • Eligibility: To purchase goods or register an account, you must be at least 18 years old and a resident of the European Union.
  • Security: You are responsible for maintaining the confidentiality of your login credentials generated via our standard form or third-party authentication (Google Sign-In). You agree to accept responsibility for all activities that occur under your account.

4. Orders, Prices, and Payments

  • Contract Formation: A binding purchase contract is formed only when we send you a formal Order Confirmation email and dispatch tracking details.
  • Pricing and Currency: All prices displayed on the website are denominated in Euros (€). Prices include applicable Value Added Tax (VAT) in accordance with EU regulations based on the destination country, unless stated otherwise. Shipping costs are calculated at checkout.
  • Payment Methods: Payments are processed securely via integrated third-party payment gateways. The MYCOTRON unit will not be dispatched until full payment clearance is confirmed.

5. Shipping and Delivery

  • Delivery Partners: We ship parcels using verified regional EU logistics networks (including Omniva, DPD, or standard EU postal services).
  • Delivery Times: Estimated delivery windows within the Baltic states (Latvia, Lithuania, Estonia) are typically 2–5 business days, and up to 5–12 business days for the rest of the EU. We are not liable for unexpected courier delays.
  • Risk of Loss: The risk of loss or damage to the goods passes to you upon physical delivery of the parcel to your designated address or parcel machine.

6. Consumer Right of Withdrawal (14-Day Return Policy)

In strict compliance with EU Directive 2011/83/EU on Consumer Rights, you have the right to withdraw from this contract within 14 calendar days without giving any reason.

  • Period: The withdrawal period expires 14 days from the day you (or a designated third party) acquire physical possession of the MYCOTRON device.
  • Condition of Goods: To qualify for a full refund, the MYCOTRON unit, its integrated sensors, fans, and microcontrollers must be returned in their original, unused condition, free from organic residue, substrate stains, or structural wear.
  • Exclusions: Consumable items, such as pre-sterilized mushroom substrate blocks or live spore/mycelium kits, cannot be returned once opened due to hygiene and bio-contamination risks.
  • Return Costs: You are responsible for paying the direct shipping costs of returning the device to our facility in Latvia.

7.1. Statutory Warranty for Consumers (B2C)

In strict compliance with EU Directive 2011/83/EU, EU Directive 2019/771, and the Consumer Rights Protection Law of the Republic of Latvia (Patērētāju tiesību aizsardzības likums), all private consumers residing within the European Union are entitled to a 2-year statutory warranty against manufacturing defects and non-conformity of hardware products from the physical date of delivery.

  • First 12 Months: Any lack of conformity that becomes apparent within the first year from delivery shall be presumed to have existed at the time of delivery, unless proven otherwise by us or incompatible with the nature of the goods.
  • Remedies: In the event of a valid hardware defect, the consumer has the right to request a repair free of charge, a replacement unit, a proportional price reduction, or a full contract cancellation (refund), subject to legal provisions.

7.2. Commercial Warranty for Business Clients (B2B)

If the goods are purchased by a legal entity, commercial enterprise, or intended for professional, educational, or commercial institutional use (indicated by entering a company name and VAT/Registration number during checkout):

  • The warranty period is strictly limited to 12 months (1 year) from the date of physical delivery.
  • The legal presumptions under EU consumer protection laws do not apply to B2B transactions. The buyer bears the burden of proving that the defect was present at the time of delivery.

7.3. Hardware Component Scope (The Device)

The statutory 2-year warranty (or 1-year B2B warranty) covers the core electronic and mechanical sub-systems of the MYCOTRON device, provided they are operated under normal residential conditions. This includes:

  • The primary control board core (ESP32-C6 and integrated PCB circuitry).
  • Climate sensor modules (temperature/humidity sensor and CO2 sensor).
  • Internal low-voltage mechanical components (automated PWM circulation fans and the 24V ultrasonic mist-maker unit core).
  • External dedicated AC/DC power adapters.

7.4. Consumables and Wear-and-Tear Items (Exclusions)

The following products and components are classified as Consumables or Wear-and-Tear items and are expressly excluded from the standard 2-year hardware warranty due to their biological nature, physical degradation, or dependency on ambient environments:

  • HEPA Air Filters & Pre-filters: These are single-use air filtration elements subject to natural clogging by airborne debris, dust, and biological spores. They must be replaced periodically by the user and carry no warranty once unsealed and exposed to air.
  • Mushroom Substrate Blocks & Spore Kits: Pre-sterilized cultivation substrates, grains, liquid cultures, or spore syringes are perishable items. We guarantee their sterility and viability strictly up to the expiration date printed on the packaging, provided they are stored in recommended dark, refrigerated, or ambient conditions. Once a substrate block or spore kit is opened, inoculated, or placed inside the humidification chamber, all commercial guarantees terminate due to irreversible external bio-contamination risks.
  • Ultrasonic Mist Transducer Disks: The replaceable piezoelectric ceramic disks inside the mist maker are subject to natural calcification and wear from water hardness. While the mist-maker housing and electronics are covered by the main warranty, the physical degradation or calcification of the membrane due to the use of non-distilled water is considered normal wear-and-tear.

7.5. Warranty Voidance and Misuse

The commercial warranty becomes immediately null and void if the defect or system failure is caused by user negligence, including but not limited to:

  • Electrical Alterations: Connecting the device to unstable power grids, overriding the built-in 24V line protections, or performing unauthorized hardware modifications, soldering, or physical routing on the PCB.
  • Firmware Modification: Flashing custom, unverified firmware or modifying the system’s core automation profiles via OS in a way that overrides hardware safe-guards (e.g., forcing the ultrasonic mist maker to run dry, disabling thermal fan cut-offs, or causing overheating).
  • Physical and Chemical Damage: Direct water immersion of the non-waterproof main control housing, physical drops, structural impact, or the use of aggressive chemical cleaning agents (e.g., concentrated bleach, acetone, or abrasive acids) inside the chamber that erode the plastic enclosure or delicate sensor membranes.
  • Illegal Biological Cultivation: Use of the automated chamber for the propagation of hazardous, toxic, or legally restricted biological substances under the national laws of the destination EU Member State.

7.6. How to File a Claim (RMA Process)

To initiate a warranty claim, the customer must email our support team at support@mycotron.eu with:

  • Proof of purchase (Order number and tax invoice).
  • A detailed description of the hardware malfunction accompanied by photographs or video logs of the diagnostic screen/error states.
  • If a return is authorized, the customer will receive a Return Merchandise Authorization (RMA) number. The device must be securely packed and returned to our facility in Latvia. For valid consumer (B2C) warranty claims within the EU, we will cover or reimburse reasonable return shipping costs. The unit must be thoroughly cleaned and free of any organic growth or substrate residue before shipping.

8. Limitation of Liability and Proper Use

  • Intended Purpose: The MYCOTRON device is engineered solely as an automated environmental chamber for domestic, culinary, and medicinal mushroom cultivation (e.g., Shiitake, Oyster, Lion’s Mane).
  • Biological Compliance: You assume full legal responsibility for ensuring that the mushroom species cultivated within the MYCOTRON device strictly comply with the national legislation of your specific EU member state. We accept zero liability for any legal infractions, health issues, or biological contamination arising from your use of the device.
  • Firmware Modding: While the system utilizes open protocols and local LittleFS systems internally, flashing custom, unverified firmware that overrides hardware safety limits (such as forcing the ultrasonic mist maker or PWM fan outside thermal limits) voids all safety certifications (CE RED / FCC) and terminates our liability.

9. Governing Law and Dispute Resolution

  • Applicable Law: These Terms and all purchasing agreements shall be governed by and construed in accordance with the laws of the Republic of Latvia, without giving effect to conflicts of law principles.
  • Dispute Resolution: Any disputes arising from these Terms shall ideally be settled through mutual negotiations. If a resolution cannot be reached, consumers may submit claims via the EU Online Dispute Resolution (ODR) platform (http://ec.europa.eu/consumers/odr/) or escalate the matter to the Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs – PTAC) in Riga, Latvia.
